On behalf of the Council, I would like to take this opportunity to wish you all a very prosperous new year of the Horse.
Following on my previous communication to you in January 2002 on the establishment of our Trade Union, I am glad to announce that the Preparatory Committee of the Trade Union has been formed with members of the present Council. According to the Trade Unions Ordinance, the Preparatory Committee has only two functions, namely:
According to the advice of the Registrar of Trade Unions and our Hon. Legal Adviser, the Constitution and Rules of the HKDU (Trade Union) has been drafted. Before approval of registration, the Rules are now being examined by the Registrar of Trade Unions. If everything is in order, the Registrar may publish our application in the Government gazette around end of February 2002 and by that time, the Preparatory Committee would start to send out membership application forms to all of you and also prepare the First General Meeting, tentatively in May 2002, for return of the First Council. Please take note of the future announcements of the Preparatory Committee which will be circulated through the Hong Kong Doctors Union Limited.
According to the majority view of our members in the Named Referendum conducted on 11.7.2001 and the mandate given to the Council in the Extraordinary General Meeting(EGM) of 15.11.2001, we are in full gear to transform Hong Kong Doctors Union Limited to Hong Kong Doctors Union (Trade Union). Following the advice of our Hon. Legal Adviser and in order to have a smooth transformation, we are going to hold an EGM of the HKDU Ltd. at 9:00 pm on 28.3.2002 (Thursday) to pass a Special Resolution to amend Article 33 to facilitate the winding up of the HKDU Ltd. Please see enclosed circular no. 2098 for the details of the EGM. Please do support your Council’s endeavor by either attending the EGM personally or appointing a proxy to voice your opinion.
Enclosed with this circulation, you will find a Members’ Opinion Survey on The Draft Declaration of Doctors’ Rights & Autonomy prepared by your Council (circular no. 2094). You may wonder why the Union has such an intention to produce a pamphlet on Doctors’ Rights. The reason is simple, while we have a pamphlet on Patients’ Rights, we should have a pamphlet on Doctors’ Rights to act as a balance. At the same time, we should carefully exercise such rights in the management of our patients. After all, most of the contents in the draft have already been endorsed by the World Medical Association and national medical associations elsewhere. Why shouldn’t we have one in Hong Kong? Again, please try you best to return the survey!

謹代表會董會祝賀大家馬年新年進步，生意興隆，步步高陞。
前次的2002年1月通訊中曾跟大家提起創辦我們的工會，現在我很高興宣佈這工會的籌備小組經已組成了，成員是由現有會董會擔任。根據職工會條例，籌備小組祗有兩個工作，其一是籌備組成工會及它的會董會，其二是招收工會會員。
根據職工會登記處與本會義務法律顧問的建議，我們已經撰寫好香港西醫聯會（工會）的憲章與會規。於獲得登記前，會規現正由職工登記處進行審閱。如無意外，職工登記局長約在2002年月下旬將會於憲報刊登我們的申請。同時籌備小組該已開始工作，發出申請入會信給所有會員，及預備暫定於2002年5月召開第一個全體會員大會以建立第一屆會董會。請留意香港西醫聯會有限公司的通訊中刊登的籌備小組通告。
根據2001年記名調查所顯示大多數會員的意願和2001年11月特別會員大會所授給會董會的權力，我們正全力進行將香港西醫聯會有限公司轉變為香港西醫聯會（工會）。為了令這變更順利進行，以達致各位的冀望，我們接納義務法律顧問的意見，定於2002年3月28日（星期四）晚上9時正召開一個特別會員大會，修改會規第33節，以便未來能將香港西醫聯會有限公司順利解散，詳情請見關於特別會員大會的會員通訊2098號。請支持會董會的努力，儘量親自參加特別會員大會或指派代表去表達你的寶貴意見。
隨通訊附上關於會董會撰寫的醫生權益與自主宣言的問卷調查（會員通訊2094號），你可能奇怪會董會為什麼要出版一本醫生權益的小冊子，原因其實很簡單，既然現時有病人權益，就該有醫生權益作一個平衡。同時要讓人看得到在照顧病人時我們是很小心地行駛醫生的權利。其實，世界醫學會及其他地方的國立醫生組織均已贊同了它大部份的內容，為什麼香港不應該也有一套呢？我再一次懇請各位踴躍參與這項調查。
